These Terms and Conditions set out the basis on which Rubbish Clearance Swiss Cottage provides rubbish removal and waste collection services. By booking or receiving any service from us, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 We, us, our means Rubbish Clearance Swiss Cottage, the provider of rubbish collection, removal and related waste services.

1.2 You, your means the customer placing a booking for services, whether as an individual or on behalf of a business or organisation.

1.3 Services means any rubbish clearance, waste collection, rubbish removal, loading, transportation, disposal or associated services we provide.

1.4 Site means the property, premises or location where our services are to be carried out.

1.5 Waste means any rubbish, junk, household waste, commercial waste or other materials that you ask us to collect and remove.

2. Scope of Services

2.1 We provide rubbish clearance and waste collection services for domestic and commercial customers within our operational area, including one-off clearances, repeat collections and ad hoc waste removal.

2.2 Our services may include loading of waste, labour to remove waste from accessible areas of your premises, transportation of waste, and lawful disposal or recycling at appropriate facilities.

2.3 We reserve the right to refuse to collect any waste that we reasonably consider hazardous, prohibited by law, excessively heavy, unsafe to handle, or outside the scope originally quoted for.

2.4 Any description of services on our website or marketing materials is for general information only. The specific services we provide will be those confirmed in your booking confirmation or quotation.

3. Booking Process

3.1 You may request a booking by contacting us via telephone, email or any other communication method we make available.

3.2 To provide a quotation and accept a booking, we may ask you for information including, but not limited to, your name, contact details, service address, description and estimated volume or weight of waste, access details and preferred service date.

3.3 Any quotation provided by us, whether verbally or in writing, is based on the information you supply at the time. If on arrival the actual waste, access or site conditions differ materially from what was described, we reserve the right to amend the quotation, apply additional charges or decline the job.

3.4 A booking is not confirmed until we have accepted it and, where requested, you have paid any required deposit or prepayment. We may, at our discretion, refuse any booking request.

3.5 We will provide an estimated arrival window for your collection. While we aim to attend during this window, it is an estimate only and not a guarantee. We are not liable for any loss or inconvenience resulting from delays caused by traffic, weather, operational issues or other factors beyond our reasonable control.

4. Access and Site Requirements

4.1 You are responsible for ensuring that we have safe, reasonable and lawful access to the Site at the agreed time. This includes arranging any necessary parking, entry permissions, keys or gate codes.

4.2 If we are unable to gain access, or if access is unsafe or significantly restricted, we may charge a call-out fee or waiting time, or treat the visit as a late cancellation in accordance with section 7.

4.3 You must ensure that the waste to be collected is clearly identified and separated from items that are not to be removed. We are not responsible for any items taken in error where items were not adequately distinguished or where you, your representative or any third party directed us to remove them.

4.4 You must inform us in advance of any potential hazards at the Site, including but not limited to structural issues, broken glass, sharps, asbestos, chemical residues or other risks to health and safety.

5. Waste Types and Regulations

5.1 We operate in accordance with applicable UK waste regulations and hold or use appropriate licences or registered carriers as required by law for the collection and transport of controlled waste.

5.2 We will not knowingly collect or carry any waste that is prohibited or restricted under relevant legislation, including, without limitation, certain hazardous materials, clinical waste, chemicals, solvents, asbestos, gas cylinders or specialist electrical items requiring separate treatment.

5.3 If prohibited, hazardous or misdescribed waste is discovered among materials you present for collection, we may refuse collection, require it to be removed from the load, or charge additional fees for safe handling and disposal where we are able to deal with it lawfully.

5.4 You acknowledge your duty of care under relevant waste legislation to ensure that waste is transferred to an authorised waste carrier and is accurately described. We will provide reasonable documentation of collection and transfer on request where applicable.

5.5 We will endeavour to recycle or recover waste where practicable in accordance with applicable environmental regulations and industry practice. However, we do not guarantee that any particular item or proportion of waste will be recycled.

6. Prices and Payments

6.1 Our prices may be based on factors including volume of waste, weight, type of materials, labour time, access conditions and disposal costs. We will explain the pricing basis at the time of quotation.

6.2 All prices are quoted in pounds sterling and may be subject to VAT where applicable. Any VAT will be clearly stated where charged.

6.3 Unless otherwise agreed in writing, payment is due on completion of the service visit. We accept payment by the methods we inform you of at the time of booking, which may include cash, card or bank transfer.

6.4 For business customers or larger works, we may require a deposit or full prepayment prior to the service date, or we may agree separate credit terms in writing. Where credit is agreed, invoices are payable within the time stated on the invoice.

6.5 If payment is not received by the due date, we reserve the right to charge interest on overdue amounts at the statutory rate and to recover any reasonable costs incurred in pursuing payment, including collection agency fees and legal costs.

6.6 We may withhold or suspend services if you have outstanding unpaid invoices or if we reasonably believe that payment will not be made in accordance with these terms.

7. Cancellations, Rescheduling and Waiting Time

7.1 You may cancel or reschedule a booking by contacting us directly. Cancellations or rescheduling requests must be made during our normal business hours.

7.2 If you cancel or reschedule with sufficient notice, typically at least 24 hours before the agreed arrival window, no cancellation fee will usually apply. We reserve the right to specify a longer notice period for large or specialist jobs, which will be communicated at the time of booking.

7.3 If you cancel, reschedule with insufficient notice, or fail to provide access when our team arrives, we may charge a cancellation fee or call-out charge to cover our reasonable costs and lost time.

7.4 If on arrival we are required to wait for access or for you to prepare waste that was not made ready as agreed, we reserve the right to charge a reasonable waiting time fee.

7.5 We may cancel or reschedule a service at any time for reasons including unsafe conditions, extreme weather, vehicle breakdown, staff illness or other events beyond our reasonable control. In such cases, we will seek to agree a new service date with you as soon as reasonably practicable, and any prepayment for services not performed will be applied to the rearranged service or refunded.

8. Customer Responsibilities

8.1 You are responsible for ensuring that you have the legal right, authority and permission to request the removal of waste from the Site.

8.2 You must provide accurate information about the waste and Site conditions at the time of booking, and update us promptly if circumstances change.

8.3 You must not request us to remove any item that you do not intend to discard. We accept no responsibility for loss of any item that you or your representative have presented to us as waste.

8.4 Where children, pets or vulnerable persons are present at the Site, you must ensure their safety and supervision and keep them away from any working area or vehicle operations.

9. Our Liability

9.1 We will exercise reasonable care and skill in providing our services. However, you acknowledge that rubbish clearance and waste handling may involve movement of bulky items, working in confined spaces or using vehicles in close proximity to buildings or fixtures.

9.2 We will not be liable for any pre-existing damage to your property, including walls, floors, paths, driveways, fixtures, fittings or surfaces, or for damage that could not reasonably be avoided while carrying out the services in the manner you requested.

9.3 We shall not be liable for any loss or damage arising from inaccurate or incomplete information you provide, or from your failure to comply with these Terms and Conditions.

9.4 To the fullest extent permitted by law, we exclude all liability for loss of profit, loss of business, loss of opportunity, loss of data, or any indirect or consequential loss or damage arising out of or in connection with our services or these Terms and Conditions.

9.5 Our total liability to you for any loss or damage arising out of or in connection with the services, whether in contract, tort, negligence or otherwise, shall be limited to the total price actually paid by you for the specific service visit giving rise to the claim.

9.6 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

10. Insurance

10.1 We maintain public liability insurance and any other insurance we consider appropriate for the nature of our business and services.

10.2 Details of our insurance cover are available on request. Our insurance does not extend your rights beyond those set out in these Terms and Conditions.

11. Complaints and Disputes

11.1 If you are unhappy with any aspect of our services, you should contact us as soon as possible so that we can seek to resolve the issue promptly.

11.2 You should provide details of your complaint, including the service date, Site address and a description of the issue. We may request photographs or further information to assist our investigation.

11.3 We will consider your complaint and respond within a reasonable timeframe. Where appropriate, we may offer a remedial visit, partial refund or other solution at our discretion, without admission of liability.

11.4 These complaint procedures do not affect your statutory rights.

12. Data Protection and Privacy

12.1 We will collect and process your personal information only as necessary to manage bookings, provide services, take payment and communicate with you.

12.2 We will take reasonable steps to keep your information secure and will not sell your personal data to third parties. We may share data with trusted service providers where required for payment processing, waste transfer documentation or operational purposes.

13. Changes to These Terms

13.1 We may update these Terms and Conditions from time to time. Any changes will take effect when published or otherwise notified to you.

13.2 The version of the Terms and Conditions in force at the time of your booking will apply to that particular service, unless a change is required by law or regulatory authority.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services provided, shall be governed by and construed in accordance with the laws of England and Wales.

14.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services.

15. General Provisions

15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

15.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

15.3 You may not assign or transfer any of your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations to another suitable provider or legal entity where reasonably required for business purposes.

15.4 These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between you and us in relation to the services and supersede any prior understandings or agreements.
